से निम्नलिखित सूचना उपलब्ध् कराने के लिए आवेदन किया है:

2. सूचना के अधिकार अधिनियम, 2005 में सूचना देने के लिए निर्धारित की गई समयाविध् के समाप्त हो जाने के बावजूद, –
– लोक सूचना अधिकारी द्वारा मुझे अब तक किसी प्रकार की सूचना नहीं दी गई है।
– मुझे जो जवाब प्राप्त हुआ है. वह अधूरा है /  गलत है / मेरे आवेदन से सम्बंधित नहीं है।

आपसे निवेदन है कि सूचना के अधिकार अधिनियम, 2005 की धरा-19(1) के तहत इस विषय पर सुनवाई करें तथा लोक सूचना अधिकारी को मुझे सूचना प्रदान करने का आदेश दें। सूचना के अधिकार के प्रावधान के अनुसार लोक सूचना अधिकारी को मेरे द्वारा मांगी गई सारी सूचना नि:शुल्क उपलब्ध् कराने का भी आदेश दें। साथ ही, सूचना के अधिकार अधिनियम के उल्लंघन के लिए लोक सूचना अधिकारी पर अधिनियम के प्रावधानों के अनुसार कार्यवाही  करने का आदेश दें।

a)    Vague, False and Incomplete Information from CPIO.
b)    Required information as per the bullet points in my RTI Application not received from the CPIO.
I am aghast to read an RTI reply like this, that too from the PIO of a Central University. It is extremely disappointing that the PIO instead of furnishing information has rejected the information on the ground that this particular RTI application is ‘to harass, unnecessary burden and tax the personnel of the university’.
From this RTI reply, it is clear that Jamia Millia Islamia does not want to be accountable and transparent to the public.
4)    Prayers:
a.      The 1st appellate authority should mention in his order recommending penal provision and direct strict disciplinary action to be taken against CPIO under Section 20 of the RTI Act for denying of information and dereliction of duty.
b.    The CPIO be penalized and strict disciplinary action be taken against him under services conduct Rules and Discipline and Appeal rules 1968 and 1969.
c.      The CPIO be directed to provide true and complete information sought by me in my RTI application.
d.    Kindly provide the information point-wise and in Hindi or English language as far as possible as required under Section 6 (1), 4 (3) and 7 (9) of the RTI Act, 2005.
e.     If any information is denied then please quote the exemption clause of Section 8 (1) and a brief reason as to how it applies. This is a requirement of the RTI Act, as per Section 7 (8) (i) read along with Section 19 (5).

मैंने सूचना के अधिकार अधिनियम-2005 के तहत राजस्थान तकनीकी विश्व विध्यालय  के जन सूचना अधिकारी को दिनांक 22.10.2011 को तीन अलग-अलग आवेदन दिया था। (तीनों आवेदनों की प्रतिलिपी संलग्न) आवेदन देने के बाद मुझसे दिनांक 29.11.2011 को जो सूचना प्राप्त हुई, वो आवेदक के साथ एक बेहुदा मज़ाक था। (प्रतिलिपी संलग्न)  जामिया ने अपने इस पत्र में सूचना देने से बचने के लिए कानून के गलत धाराओं का हवाला दिया गया है, जो किसी भी रूप में मेरे द्वारा पूछे गए प्रश्नों पर लागू नहीं होता। इस प्रकार देश के नागरिक होने के नाते मेरे अधिकारों की अनदेखी हुई है। सूचना का अधिकार क़ानून की अवहेलना हुई है और देश के इतने बड़े शैक्षणिक संस्थान की गरिमा भी कलंकित हुई है।
अत: इस संदर्भ में श्रीमान से यह निवेदन है कि सूचना के अधिकार अधिनियम की धारा-18  के तहत इस विषय पर सुनवाई करते हुए जन सूचना अधिकारी को तुरंत सूचना उपलब्ध कराने का आदेश दें। साथ ही, सूचना के अधिकार अधिनियम के उल्लंघन के लिए जन सूचना अधिकारी पर अधिनियम के प्रावधानों के अनुसार जुर्माना भरने का आदेश दें।
मैं आशा करता हूं कि मेरे इस शिकायत पत्र को गंभीरता से लेते हुए इस दिशा में तत्काल कार्यवाही की जाएगी ताकि मुझे जानकारी मिल सके और सूचना कानून में नागरिकों (छात्रों) को दिए गए अधिकारों का मान व मर्यादा बनी रह सके।
आपसे न्याय की अपेक्षा सहित,
5.Prayers:
a)     ENQUIRY: Sir, exercising powers of Civil Court vested in you under section 18, please enquire into this Complaint.
b)    DIRECTIONS TO PIO: Sir, please direct PIO to comply with requirements of Sec 7(1) and give proper reply to RTI Application.
c)     PENALTY: Sir, please impose penalty as per Section 20 as the PIO, “without any reasonable cause, refused to receive an application for information or has not furnished information within the time specified under section of RTI Act-2005 ”.
d)    DISCIPLINARY ACTION: Sir, please recommend disciplinary action against PIO as per Section 20(2), who has, without reasonable cause and persistently” denied my request for information.
e)     The CPIO be penalized and strict disciplinary action be taken against him under services conduct Rules and Discipline and Appeal rules 1968 and 1969.

नई दिल्ली, एजेंसियां : सुप्रीम कोर्ट ने आइआइटी, खड़गपुर के कंप्यूटर साइंस के प्रोफेसर राजीव कुमार की जमकर तारीफ की है। कुमार ने आइआइटी में दाखिले के लिए आयोजित संयुक्त प्रवेश परीक्षा (जेईई)-2006 में कट ऑफ तय करने की प्रक्रिया को चुनौती दी थी। अदालत ने कहा कि कुमार उन गुमनाम नायकों में शामिल हैं जिनके प्रयासों से सिस्टम में सुधार लाने में कामयाबी मिली। हालांकि देश की सर्वोच्च अदालत ने कुमार के बेटे को आइआइटी में दाखिला देने की याचिका को खारिज कर दिया। सुप्रीम कोर्ट में न्यायमूर्ति आरवी रवींद्रन एवं एके पटनायक की पीठ ने कुमार की याचिका पर सुनवाई करते हुए यह स्वीकार किया कि जेईई-2006 में कट ऑफ तय करने के लिए अपनाई गई प्रक्रिया सबसे अच्छी नहीं कही जा सकती है। कुमार की प्रशंसा करते हुए पीठ ने कहा, याची को इस बात से संतुष्ट होना चाहिए कि वह उन अनाम नायकों में शुमार है जिनके कारण सिस्टम में सुधार आया। मुकदमा दायर करने वालों ने जेईई-2006 की कट ऑफ प्रक्रिया को चुनौती दी। आरटीआइ आवेदनों के जरिए इसमें पारदर्शिता लाने की कोशिश की और इस पर स्वस्थ बहस को जन्म दिया।

4. File complaint with State or National Human Rights Commission:

As per news reports, few years back, Bihar Human Rights Commission had admitted complaint against breach of right to information. Fate is not known but it can also be tried out. Dr. Rao of Mysore opened up RTI to Consumer Protection Mechnism. Similarly new avenue can be opened up under Human Rights for RTI. I quote:

Access to government information is a human right, according to a commentary issued in July, 2011 by the United Nations’ Human Rights Committee. The comment is the most comprehensive statement to date embracing freedom of information as integral to human rights under international law.

Above steps can be initiated at any stage of RTI process.
